1. Introduction and Business Status
SURA Limited, trading as Nucap (“Nucap”, “we”, “us”, or “our”) is a commercial credit introducer and intermediary. Nucap is registered in Ireland (Company Registration Office Number: [Insert CRO Number]). Our registered office is located at [Insert Registered Address, e.g., IE-DUB-GAS-6-601A].
Nucap operates as an independent commercial credit broker and is not a lender. We do not provide balance-sheet capital, make credit decisions, or issue formal credit facilities directly to applicants.
2. Regulatory Disclosure and Consumer Exclusion
NUCAP PROVIDES SERVICES EXCLUSIVELY ON A BUSINESS-TO-BUSINESS (B2B) BASIS.
Our platform, matching engine, and introducer services are strictly restricted to incorporated corporate bodies, including Private Limited Companies (LTD), Designated Activity Companies (DAC), and Public Limited Companies (PLC).
NUCAP DOES NOT ASSIST, ADVISE, OR BROKER FINANCING FOR:
Natural persons, consumer borrowers, or private individuals.
Unincorporated sole traders, sole proprietors, or partnerships.
Regulated consumer credit agreements, personal home mortgages, or hire-purchase agreements falling under the scope of the Consumer Credit Act 1995 or the Consumer Protection Code.
By submitting an application or utilizing nucap.ie, you warrant and represent that you are an authorized director of a legally incorporated Irish company and are acting solely for purposes relating to your trade, business, or profession.
3. Our Services and Matching Engine
Nucap provides an automated, digital credit-matching platform. By inputting your company details, credit requirements, and financial parameters, our system parses public CRO registry data and matches your business profile with the underwriting criteria of our panel of third-party non-bank lenders.
While we endeavor to match you with compatible lenders, Nucap does not guarantee:
That you will be matched with a lender.
That any matched lender will issue an Indicative Term Sheet or offer credit.
That any offered credit terms are the lowest or most favorable rates available in the market.
4. Borrower Consent, Data Transmission, and Introductions
You acknowledge that Nucap cannot introduce your company to lending partners without securely transmitting your commercial profile.
By completing our online form and checking the mandatory consent boxes, you grant Nucap explicit authorization to:
Query public registries (such as the Companies Registration Office) to retrieve and verify your company’s legal standing, filing history, and registration details.
Package your submitted data into a Nucap Commercial Credit Memo.
Transmit this Credit Memo, including your personal and corporate contact details, directly to the commercial underwriting and business development desks of our matched panel lenders.
Once an introduction is successfully transmitted, you will deal directly with the matched lender to finalize documentation, complete Know Your Customer (KYC) / Anti-Money Laundering (AML) checks, and execute drawdown.
5. Fees and Broker Compensation
Nucap’s matching service is 100% free to borrowers. We do not charge upfront application fees, advisory retainers, or packaging charges.
We are compensated directly via a standard intermediary commission or procurement fee paid to us by the matched lender only upon the successful funding and drawdown of your commercial facility. Our commercial relationship with lenders does not impact the objectivity of our matching algorithm.
6. Limitation of Liability
Nucap is not liable for any losses, damages, or business disruptions arising from:
Any decision by a panel lender to decline your application or stall underwriting.
Any technical delays, outages, or errors in our API integrations (including the CRO registry).
Any breach of contract, negligence, or dispute occurring between your company and a matched lender after an introduction has been completed.
7. Governing Law and Jurisdiction
These Terms of Service and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Ireland. The courts of Ireland shall have exclusive jurisdiction to settle any dispute or claim.
